Overview 

This program will familiarize you with the technical and legal rules for drafting a properly structured dispute resolution clause free from defects that could block the enforcement of the clause when a dispute arises or invalidate an arbitration award or settlement agreement after proceedings begin.  

The importance of the program stems from the importance of alternative dispute resolution, a range of alternative methods for achieving justice in commercial disputes. The dispute resolution clause is the cornerstone on which the proceedings rest, and in order to be effective when a dispute arises, it must be properly formulated when the contractual relationship between the parties is established.  

Whether you are a lawyer, a contracts counsel, an arbitrator, a mediator, or a conciliator, this program concerns you first of all, meaning anyone interested in laying the proper foundations for contractual relationships in the business sector.

Dr. Mostafa Abdelghaffar

• Partner at Majid Al-Rasheed Law Firm and Legal, a member of the Saudi Center for Commercial Arbitration Court, and a member of the SCCA Advisory Committee.

• With thirty-two years of experience in the judicial and legal field, he has progressed in his judicial career until he served as a judge at the Court of Appeal. He also worked as a consultant in the Department of International and Judicial Cooperation at the Egyptian Ministry of Justice, a legal advisor at the Legal Affairs Directorate in the Kingdom of Bahrain, then as Director of the Judicial and Legal Studies Institute in Bahrain, followed by serving as Director of Dispute Resolution at the Saudi Center for Commercial Arbitration, and later as an Counselor to the Saudi Bankruptcy Committee.

• During his tenure at the Egyptian Ministry of Justice and the Legal Affairs Directorate in Bahrain, he participated in negotiating, reviewing, and drafting numerous bilateral and multilateral international agreements, particularly Bilateral Investment Treaties (BITs) and agreements on judicial cooperation and mutual legal assistance.

• He has participated in providing several consultations for the United Nations Office on Drugs and Crime (UNODC), the United Nations Development Programme (UNDP), and the United Nations Support Mission in Libya (UNSMIL) in areas related to judicial governance, legislative review and compliance with international standards, and legislative policy development in several countries, including Iraq, Jordan, Egypt, and Libya.

• He has published several articles and books in the fields of arbitration, justice administration, and international law.

• He is a member of the Chartered Institute of Arbitrators (CIArb) Faculty and a listed arbitrator with the Shanghai Arbitration Commission (SHAC), the Cairo Regional Centre for International Commercial Arbitration (CRCICA), and the Saudi Center for Commercial Arbitration (SCCA).

• He has served as a sole arbitrator, a panel member, and a party representative in various cases managed by the International Centre for Settlement of Investment Disputes (ICSID), the International Chamber of Commerce (ICC) Court of Arbitration, and the Saudi Center for Commercial Arbitration.

• He holds a PhD in international law from Alexandria University and a diploma from the International Institute of Human Rights in Strasbourg.
