Law, practice, and procedure of international arbitration 

This module focuses on providing candidates with knowledge of the principles and practice of international arbitration. It is therefore the starting point for anyone who wants to get started in arbitration or is involved in arbitration cases as a party, representative of a party, witness, or expert.  

Objective 

To understand international arbitration procedures and be able to employ legislation and regulations based on the UNCITRAL Model Law on International Commercial Arbitration and the UNCITRAL Arbitration Rules.  

Learning Outcomes 

  1. Awareness of the meaning of international arbitration. 

  1. Familiarity with the principles, rules, and agreements for the practice of arbitration, and the ability to apply them. 

  1. Understanding of the legal basis of arbitration. 

  1. Understanding of the contractual nature of arbitrator appointments. 

  1. Understanding of the arbitrator’s powers and functions. 

  1. Understanding of the rights and duties of the parties to arbitration cases. 

  1. Understanding of the relationship of the courts to arbitration proceedings. 

  1. Understanding of the requirements for the enforcement of arbitral awards. 

  1. Ability to apply the principles and legal requirements of arbitration. 

  1. Ability to apply the provisions of the UNCITRAL Model Law on International Commercial Arbitration. 

Content:

Delivery Method and Duration 

Three months of self-study interspersed with a tutorial at the end of each month of the course. In the tutorial, participants will meet with the tutor to review the material, share what they have learned, respond to problems, and find solutions.  

Assessment 

There will be a remotely administered written exam. Candidates must begin the exam within five days after it is uploaded to the learning platform and will have 48 hours to complete it. Exam results will be sent to candidates 12 weeks after the date of the exam. 

Admission Requirements 

There are no prerequisites or requirements to enroll in Module 1.  

Results of successful completion 

After passing Module 1, candidates will be eligible for: 

  1. A completion certificate issued by CIArb. 

  1. CIArb membership at the MCIArb grade. 

  1. Listing in the SCCA Arbitrator Roster if they meet the other admission criteria.  

Trainer

Dr. Emad Eddien Hussein
  • Dr. Emad Hussein is an independent Chartered Arbitrator, an Accredited Mediator and a keen academic in international arbitration and mediation practicing across the MENA region with a focus on the Gulf states. 
  • He has served as chairperson, sole arbitrator and co-arbitrator across several institutional and ad hoc arbitrations and is listed on the arbitration rosters of the International Chamber of Commerce (ICC), the Hong Kong International Arbitration Centre (HKIAC), the Singapore International Arbitration Centre (SIAC), the Dubai International Arbitration Centre (DIAC), the American Arbitration Association – International Centre for Dispute Resolution (AAA-ICDR), Cairo Regional Centre for International Commercial Arbitration (CRCICA), Qatar International Centre for Conciliation and Arbitration (QICCA), Saudi Centre for Commercial Arbitration (SCCA) and the Libyan Centre for International Commercial Arbitration (LCICA).
  • He is a longstanding Fellow of the Chartered Institute of Arbitrators and on the ‘Approved Faculty List’ (AFL) for tutoring the International Arbitration Fellowship programs with the CIArb. 
  • Additionally, he is a Senior Fellow with the Singapore International Dispute Resolution Academy (SIDRA), Singapore where he has initiated and led research programs for the advancement of ADR in the MENA region.
  • He is a listed mediator on the panel of the CAO (Compliance Advisory Ombudsman) at the World Bank.Accredited Mediator at the Centre for Effective Dispute Resolution (CEDR) London, UK, the Singapore International Mediation Institute (SIMI) and the International Mediation Institute (IMI). Further, he is an empanelled mediator at the Abu Dhabi Global Market Arbitration Centre (ADGMAC), the Investors’ Dispute Settlement Centre (IDSC), the Saudi Centre for Commercial Arbitration (SCCA), the Cairo Regional Centre for International Commercial Arbitration (CRCICA), the SAGE Mediation Institute, the International Academy of Mediators (IAM). 
  • He is also actively involved in various ADR training and capacity building projects in collaboration with the United Nations Commission on International Trade Law (UNCITRAL), the United Nations Development Programme (UNDP), the Commercial Law Development Program (CLDP), the Arab and Gulf Ministries of Justice, Trade, Investment and several arbitral institutions. He has published and spoken extensively in both Arabic and English on issues related to commercial law, international and domestic arbitration and mediation. 
  • He is also involved in an advisory capacity on the Boards of the British University (BUiD) in Dubai and the Centre for Dispute Resolution (InnovADR) in Geneva, Switzerland for developing and conducting training programs in commercial law and international dispute resolution.
  • Member at ICC Institute of World Business Law Chamber of Commerce – France.
  • He holds a PhD focusing in International Commercial Arbitration from the SOAS, University of London, UK; a PhD in International Business Management from the International School of Management (ISM), USA; an LLM in International Business Law (with a focus on International Arbitration) from the Queen Mary University of London (QMUL), UK and an LLM in Mediation and International Commercial Dispute Resolution from the School of Law, Newcastle University, UK.
